HELENA, Mont. (NMB) – The Montana State News Bureau reports that Attorney General Austin Knudsen has taken over a criminal case after the Lewis and Clark County Attorney refused to drop two misdemeanor concealed-carry charges filed against a Helena man that allegedly assaulted a restaurant employee who asked him to wear a mask.
A trial had been set for August 30th, but settlement negotiations are now ongoing.
According to court documents, Rodney Robert, 45, assaulted two employees and displayed a holstered gun last November after being asked to wear a mask.
Robert did not have a permit to concealed carry.
In the months after the altercation, the State Legislature passed a bill making it legal to conceal carry without a permit, as long as it is in places where people can open carry and if it is in self-defense.
