HELENA, Mont. (NMB) – The Montana Highway Patrol has found a missing video tape from a 2017 crash that could be used as evidence in an ongoing civil suit that was filed by a driver who said a trooper forced him off the road and into a ditch while traveling 70 miles per hour, according to the Montana State News Bureau.
MHP is asking a District Court for sanctions that were imposed on them to be removed. However, the plaintiff in the case, Wyoming high school principal Mitchel Burgess, is requesting additional sanctions and says this further complicates the case.
Last December, District Court Judge Kathy Seeley sanctioned MHP for losing dash cam footage of the incident, in which Trooper Michael Howell is accused of pulling an illegal U-Turn on Highway 59 near Miles City.
A jury is set to determine the amount of damages that Burgess is owed at an August trial.
