HAVRE, Mont. (NMB) – A man accused of threatening to kill his spouse and officers in December 2019 in Hill County has pleaded guilty.
Francisco De La Rosa Valencia, Jr., pleaded guilty to felony assault with a weapon in Hill County District Court on Monday.
If the plea agreement holds, the other four charges will be dropped. That includes two counts of felony intimidation, one count of misdemeanor partner or family member assault and one count of resisting arrest.
In January, Valencia initially pleaded not guilty on all counts.
According to an affidavit filed on January 8th, Valencia arrived at his spouse’s apartment on the night of December 30th with a box cutter with a razor-type blade. Valencia threatened to kill the victim, who went to the police department to alert authorities.
Authorities later arrived at the residence to confront Valencia. Valencia shouted profanities at the officers and threatened to kill them. Valencia refused to open the door, but officers were eventually able to partially open it, at which point they Tased Valencia in his left leg. Officers then arrested Valencia and transported him to the Hill County Detention Center.
Sentencing is set for June 1st.
Valencia also admitted to violating the conditions of his release in a 2016 Hill County Court Case where he was convicted of failing to register as asexual or violent offender. Valencia was sentenced to 60 months, all suspended, in that case.
In 2016, Valencia was also convicted of assault on a peace officer and sentenced to 24 months in the Department of Corrections, with none suspended.
On Monday, the court agreed to let Valencia out of the Hill County Detention Center on his own recognizance, subject to certain conditions.
Valencia had been in the Hill County Detention Center since December 30th.
