Montana University System to Seek Judicial Review of House Bill 102

BOZEMAN, Mont. (NMB) – The Montana University System Board of Regents have announced that they will be seeking a judicial review of House Bill 102, which limits their authority to restrict firearms on campus and allows students who pass safety certification to conceal carry without a permit.

In a statement, the Board says that they believe that the recently signed law may violate the Montana Constitution by limiting their authority to manage and control the Montana University System.

The bills sponsor, Republican Seth Berglee of Joliet, called the decision ‘unfortunate’ and says the Board of Regents is attempting to “deny a student’s constitutionally protected rights.”

The lawsuit puts $1 million that the legislature allocated for funding the law’s implementation on Montana college campuses in jeopardy.
