HELENA, Mont. (NMB) – Montana District Court Judge Michael McMahon has ruled that the implementation of a new campus carry law is indefinitely suspended until the issue of the law’s constitutionality is settled.
McMahon sided with the Montana Board of Regents on Monday by continuing the hold on the implementation of the law, which was supposed to take effect on June 1st. The law, House Bill 102, would allow students and staff who meet safety certifications to carry firearms on public college campuses.
The Board of Regents have argued that the law usurps the authority granted to the Regents by the Montana Constitution. Those in support of the law argue it protects people’s second amendment rights granted by the U.S. Constitution.
The Board of Regents and the Attorney General’s Office remain at odds about the law, which continues to make its way through the court system.
