HAVRE, Mont. (NMB) – A Havre man has been given a five year suspended sentence with the Department of Corrections after pleading guilty to felony assault with a weapon after allegedly threatening to kill both his spouse and officers with a box cutter.
Judge Kaydee Snipes-Ruiz sentenced Francisco Dela Rosa Valencia, Jr., born 1974, on Monday in Hill County District Court.
As pursuant to the plea agreement, the two counts of felony intimidation as well as misdemeanor partner or family member assault and resisting arrest were dismissed.
According to an affidavit filed on January 8th, Valencia arrived at his spouse’s apartment on the night of December 30th, 2019, with a box cutter with a razor-type blade. Valencia threatened to kill the victim, who went to the police department to alert authorities.
Authorities later arrived at the residence to confront Valencia. Valencia shouted profanities at the officers and threatened to kill them. Valencia refused to open the door, but officers were eventually able to partially open it, at which point they Tased Valencia in his left leg. Officers then arrested Valencia and transported him to the Hill County Detention Center.
Snipes-Ruiz also continued Valencia’s 60 month suspended sentence from a 2016 case in which he was convicted of failure to register as a violent or sexual offender, a felony. That suspended sentence expires on September 8th, 2021.
Also in 2016, Valencia was convicted of assault on a peace officer, a felony, and sentenced to 24 months in the Department of Corrections, with none suspended.
As part of the sentence handed down Monday, Valencia must continue all treatment protocols recommended by providers and undergo anger management counseling.
Valencia will be placed under the supervision of DOC, subject to numerous conditions.
