Montana Supreme Court rules against Gianforte

(Montana) The Montana Supreme Court on Tuesday, January 17th denied a request from state officials to pause a district court judge’s ruling made in August 2023.

In mid august of 2023, 16 youth plaintiffs sued the state of Montana for “failure to consider greenhouse gas emissions from energy and mining projects”, which they say violates Montana’s state constitution because it doesn’t protect the people of Montana’s right to a clean and healthful environment.

Lewis and Clark County District Court Judge Kathy Seeley sided with the young plaintiffs in her decision, striking down two laws in the process as unconstitutional.

State officials filed to pause the judges ruling, which the Supreme Court denied on January 17th in a 5-2 decision.
