New Judge Presiding Over Plentywood Rape Case

PLENTYWOOD, Mont. (NMB) – The Independent Record reports that a court case dealing with allegations that a Plentywood man raped two developmentally disabled women will have a different judge.

The previous District Court Judge, David Cybulski, is also a Plentywood resident, which raised concerns about a potential conflict due to the small size of the town.

The case will now be heard by District Court Judge Brenda R. Gilbert.

The defendant, Timothy Ray Marsh, 62, is facing three counts of sexual intercourse without consent of two developmentally disabled women.

The trial is scheduled to begin in February. Marsh previously pleaded not guilty and has bonded out of jail.
