HELENA, Mont. (NMB) – Numerous medical providers in the state are challenging House Bill 702 in court, which banned discrimination based on vaccination status in Montana.
The lawsuit was filed Wednesday in U.S. District Court by plaintiffs that include the Montana Medical Association, private physicians, Providence Health and patients, with the defendants listed as the Montana Attorney General as well as the Commissioner of Labor and Industry.
The plaintiffs argue that the law violates the right “to a clean and healthful environment,” that is guaranteed in the state’s constitution. They are asking the judge to rule that the law should not apply to hospitals and medical providers.
