MACo, Wild Montana, Montana Wildlife Federation Respond to Senate Bill 442 Ruling

(Upper Seven Law) – The Montana Association of Counties, Wild Montana, and the Montana Wildlife Federation recently responded to Governor Greg Gianforte’s motion to stay a district court ruling.

The ruling ordered Gianforte to comply with a constitutional obligation to return his veto of Senate Bill 442 to the Secretary of State. The bill directs tax revenue from recreational marijuana for use in conservation efforts, local infrastructure projects, and veteran services.

MACo and the organizations opposed the stay, calling it a delay tactic from the January ruling. Neither Gianforte nor Secretary Jacobsen have complied with the order. The governor sought the stay without seeking appeal.

Jacobsen may resolve the case by polling the Legislature on the veto.
