Small Businesses Sue Secretary of State Over Alleged Overcharges

HELENA, Mont. (NMB) – 7 small businesses have filed suit against the Montana Secretary of State’s office based on allegations that they refused to refund money after the Secretary’s website double-charged customers for fees.

The Independent Record reports that the lawsuit was filed by the non-profit law firm Upper Seven Law in State District Court.

The plaintiffs are seeking not only a refund for the total overcharge claim of $120,000, but also a declaration that the policy is illegal. They would like the policy to be put to an end and for all people affected by it to be notified and refunded.

It is unclear how many businesses were impacted, but the Secretary of State’s office has said it is “a small number.”

The issue was made public in 2020 in a Lee Newspapers article, back when Christi Jacobsen was deputy Secretary of State and Corey Stapleton was Secretary of State.
